_On 25 June 2020, the CSSF launched a new “Delegation” functionality for “UCI approval” requests. Read below the CSSF communication.
As of 25 June 2020, it is possible to give read-only access for a specific request to stakeholders (natural persons) concerned, and to manage the delegations given on the different requests.
All communication between the applicants and other stakeholders concerned will remain by email. Please see the user guide on eDesk portal for more details.
_On 22 April 2020, the Luxembourg Government approved a new bill relating to professional payment guarantees which has now been submitted to the Parliament.
The main purpose of the bill is to introduce a special regime for personal guarantees granted within a professional framework, broadly inspired by the law of 5 August 2005 on financial collateral arrangements, as amended (the “Financial Collateral Law”).
_The joint committee of the three European Supervisory Authorities (EBA, EIOPA and ESMA together, the “ESAs”) have issued a Consultation Paper seeking input on proposed Environmental, Social and Governance (ESG) disclosure standards for financial market participants, advisers and products.
These standards have been developed under the EU Regulation on sustainability-related disclosures
_On 25 March 2020, Luxembourg implemented certain provisions of the 5th anti-money laundering directive (the ‘AMLD5’) by way of a law (the ‘Transposition Law’), which entered into force on 30 March 2020.
_On 3 April ESMA released its Final Report and Guidelines on performance fees in UCITS and certain types of AIFs. The report includes responses to its July 2019 Consultation Paper (CP) on proposed draft Guidelines on performance fees in UCITS and certain types of AIFs.
